BLACKHOUSE TERMS AND CONDITIONS / DISCLAIMER.

1. PRICES.
All prices shown are in effect from January 2009.
All prices are quoted in UK Sterling.
Pricing may change due to sale items or discontinued lines.
All prices shown are exclusive of VAT.
2.ORDERING with BlackHouse, simply enter all your personal details & Credit Card details into the BlackHouse order form, these details are completly confidential and will not be passed onto any third parties.
Once you have placed your order with BlackHouse we will then send you a "Confirmation of Order Received" Email. If you place your order on a weekend or evening (after working hours), we will then send you confirmation either the next day or on the Monday after the weekend.
Once you have placed your order, your details are sent automatically to WorldPay for processing. They will first "Capture" your payment and send you payment confirmation.
Once the payment has been "Captured" by WorldPay the payment is then in their system,There is then 5-7 working days for the payment to be "Settled" ( in other words paid in full ) by WorldPay to BlackHouse.
BlackHouse has no control of the time period from Capture to Settlement by WorldPay.
Only then will we Dispatch any items ordered via either 1st class Recorded or Next Day Delivery or International Signed For, all items must be signed for when delivered
We will only dispatch items to the customers "Credit/Debit Billing Address" provided with no exception.
All customer are asked to provide a contactable Email or Telephone number.
3.CREDIT CARD SECURITY. BlackHouse use WorldPay to securely transfer your credit/debit card details when you place an order with BlackHouse. WorldPay are a secure third party credit card company. This means they take your Credit/Debit Card details and process them internally via your bank or credit/debit card company in a secure manner. WorldPay are industry leaders in this feild, and have many years experience in dealing with all types of card transactions. By working alongside with them, BlackHouse can assure customers that they are getting the most secure online service with WorldPay, by protecting customers from any possible fraud or misuse of your details. WorldPay customers and merchants alike can have the confidence that nobody can impersonate WorldPay to obtain confidential information.
Customers should be aware that BlackHouse has no control or access any credit/debit card details through WorldPay, BlackHouse cannot process payments made to WorldPay any quicker than specified to us by WorldPay.
Once you place your order with BlackHouse, your credit/debit card details are then "Captured" in other words they are ready to be processed by WorldPay. The WorldPay processing of your payment takes between 5-7 Working days, and until we receive confirmation that the account has been "Settled" in other words paid for in full with no problems, it is only then that we can dispatch goods.
Should there be any problems arising from this, WorldPay will contact BlackHouse regarding this, we will in turn contact the customer. BlackHouse are never given details as to why the payment may be rejected by WorldPay.
BlackHouse reserves the right to with hold any item until payment in full has been "Settled" by worldPay.
4.PAYMENT for any goods ordered + delivery charge through our online site, must be paid for in full prior to any goods being dispatched from BlackHouse.
If for any reason your payment is refused to us by WorldPay, we will not be obliged to dispatch any goods and will notify you by email regarding this.
5.DELIVERY & POSTAGE, will send you a "Dispatch Email" as soon as we receive "Settlement" of payment for the goods from WorldPay.
All BlackHouse goods are sent out in a bubble padded envelopes for extra protection while in transit.
The goods ordered will only be dispatched to the "Customers Billing Address" , in other words, the address that the credit card bill is sent too, with no exception, we must do this to ensure that your card details have or are not being used by someone fraudulently.
We ask that you allow 5-7 days for "Settlement" by WorldPay, and as soon as we receive confirmation of payment in full we will dispatch the goods to you via either "1st class Recorded Delivery" /"Next Day Signed For" or for delivery outside the UK by "International Signed For" all Via the Royal Mail, so it is important that there is someone at the delivery address to sign the receipt for the goods.
However if there is no one there to sign for the item or collect it from the depot in the time stated by the Royal Mail or other countries internal mail system, and the goods are returned to BlackHouse, we wil notify you by email and refund you via the Credit/Debit Card used to make the initial payment within 14 Days of the return of goods, less the cost of the return postage paid by BlackHouse.
Delivery - We ask that you allow a Total of 14 Days in the UK and Ireland and 21 days outside the UK , from the DAY that you place your order with BlackHouse, to Delivery to you. ( Although we always aim to get the goods to you asap.)
BlackHouse cannot be responsible for any delay in delivery due to Postal Strikes, Acts of God (Force Majeure) within or outside the UK.
Postage will be automatically added when you place an order, postage is calculated per Basket, regardless of how many items you may have ordered.
Postage is charged at- UK £4, Europe £11, Rest of World £15.
6. RETURN & CANCELLATION
BlackHouse must be informed of any cancellation within 48 hrs of you placing the order through the website , either by Email or by Telephone.
Once you receive your order, you have the right to return goods to BlackHouse If you decied the items are just not suitable at any time up to the end of 7 working days after you receive the goods, A working day is classed as any day other than the weekend or public holidays.
if you decied to return the goods outside this time period, BlackHouse will consider, but is not obliged to accept any returns outside the time period quoted in the BlackHouse Terms & Conditions.
You must contact BlackHouse either by Telephone of Email to inform them of the expected return date.
We also ask that you complete our BlackHouse "Returns Form"
If you would like to return an item please complete our Returns Form.
If you wish to return any goods to BlackHouse, you are responsible for returning the goods to us at your own cost.
All goods must be returned to BlackHouse to the address given in the contact page.
You are responsible for the goods while in your care and you must take all resonable care to ensure that the goods are returned to us in there original condition.
You are asked to return all goods by Recorded Delivery to ensure proof of postage as BlackHouse cannot be responsible for any goods lost or damaged in transit, we will not refund you until we have the goods returned.
Only once we have received the goods and are satisfied that they are in good clean condition, we will refund your original credit/debit card within 21 days of us receiving the item.
We will not under any cirumstances refund you by cheque or onto any other credit/debit card.
7.COPYRIGHT PROTECTION.
All BlackHouse Designs / Features / Styles and images are protected by Copyright. Any individual / Persons / Company or Outlet found to be replecating / Copying these designs without the express consent of BlackHouse, will be prosicuted in a Scottish Court under Scottish Law.
It is stricktly forbidden to RESELL any BlackHouse PRODUCTS through, or on to any RETAIL OUTLETS, wheather through the internet, either inside or outside the UK.
Legal action will be taken on any persons/individuals or outlet found doing so and will be prosicuted under Scottish Law.
PLEASE NOTE:- BlackHouse reserves the right to REFUSE to dispatch and deliver any goods ordered through the BlackHouse internet website, where there is an unusual amount of BlackHouse products being ordered in a short period of time, ie. 5 Bags in 5 weeks, and it suspects that BlackHouse products are being RESOLD. BlackHouse will email you, although we are not obliged to give resons for the refusal, and we will refund your payment within 28 Days, through WorldPay once we receive Settlement of the initial payment.
8. DISCLAMER.
Each BlackHouse item is made individually handmade and therfor we cannot guarentee that every item will be identical, The sizes given are an approximation only. BlackHouse takes all possible care to reproduce and describe items as accuratly as possible, and due to graphic Printing/Scanning limitations, all colours represented may not be an exact representations, but as close as possible to the actual colour. Unfortunatly, due to the fact that BlackHouse only use short runs of Harris Tweed, we are unable to send customers swatches.
We cannot guarentee that the goods are totally waterproof, although Harris Tweed is naturally water repeliant.
BlackHouse cannot make any items to order.
NOTICE TO ALL CUSTOMERS.
Please ensure you carefully read all the" BlackHouse Terms & Conditions" in this Section before ordering any goods from BlackHouse. This Terms will apply to you every time you place an order with BlackHouse.
All users are subject to these Terms & Conditions and Disclamers set forth in this section itself under Scottish Law.
By accessing or using any part of the BlackHouse website, you expressly agree too and consent to be bound by all of the Terms & Conditions/Disclaimers listed in this agreement.

Applicable Law- The Terms of Sale and the Supply of goods are all subject to Scottish Law. Any disputes arising will be delt with by the Scottish Courts.
